Construction worker guilty of fraudulently collecting unemployment

An Ashburnham, Mass., man pleaded guilty Jan. 3 to fraudulently collecting about $28,000 on two unemployment benefit claims while working for a construction company.

Robert Hurtubise, 50, pleaded guilty in Suffolk Superior Court to 47 counts of unemployment fraud and one count of larceny of more than $250, according to Massachusetts Attorney General Martha Coakley.

Between January 2008 and October 2009, Hurtubise applied for and received unemployment benefits on two separate occasions from the Executive Office of Labor and Workforce Development’s Division of Unemployment Assistance (EOLWD\DUA). But Hurtubise was working full-time for the same employer and failed to disclose his employment status to EOLWD\DUA.

For each of the 47 weeks that Hurtubise collected unemployment benefits, he notified the EOLWD\DUA that he was not working, but that he was able to work and was available for work.

Hurtubise was sentenced to five years probation and ordered to pay $27,980 in restitution.
